Sexual harassment: four "wise men" know the applicant
Gerard Ducray, the author of the priority issue of constitutionality (QPC), which led to the Constitutional Council to censure the law on sexual harassment, will be milled and broken sentence.
However Mr Ducray is not a total stranger at least four Council members. He was Secretary of State for Tourism from 1974 to 1976, the Head of State was then Valéry Giscard d'Estaing, Prime Minister Jacques Chirac, both members of the Constitutional Council, even if they no longer serve .
However, Jacques Barrot, who was Secretary of State for Housing in the same government that Mr. Ducray himself has ruled on the QPC has actually overturned the conviction of his former colleague. Hubert Haenel, who also served, was his adviser aside for legal issues at the Elysee Palace from 1975 to 1977.
If board members are impartial, they must also legally give the "appearance", and fault for two of them have deported (abstaining from sitting), there is again the question of the composition of the Board. "The conditions are very strict offset, argued the high court, the only question is whether the members participated in the development of the standard, that is to say, the vote law. This is not the case. "
